1. General

The following terms and conditions apply to all orders placed by the customer (hereinafter referred to as "you", “the buyer” or “the recipient”) with BOSEMBO.com, hereinafter referred to as "BOSEMBO", "us" or "we", via the BOSEMBO desktop website or the mobile website .

By using bosembo.com and/or placing an order, you agree to be bound by the terms and conditions below (the “Terms”). Please read and understand the terms and conditions before placing your order.

Only persons of 18 years or older, who are not under guardianship and who do not act in the capacity of a company, with a residential address in the Netherlands (with the exception of the BES islands) can place an order. Orders paid with iDEAL can be made from the age of 16.

The fact that products or services are offered on bosembo.com at any time is not a guarantee that such products or services will be available at all times. We reserve the right to withdraw products at any time.

We reserve the right to change these terms from time to time without notice to you. The version of the terms and conditions applicable to your order is the version available on bosembo.com at the time of placing your order.

BOSEMBO wants to offer you the best possible online experience. To make this possible, we need to make sure our services run seamlessly. You understand and agree not to:
(i) post, transmit, redistribute, upload, or promote any communications or content that could be harmful or adversely affect our businesses, products, or services;
(ii) act in a manner that or use any device that restricts, harms, interferes with or inhibits other users from using or enjoying the website, or affects the security of the website;
(iii) use any device or attempt to use any engine, software, tool, agent or other device or mechanism (including, but not limited to, spiders, bots, crawlers, avatars or intelligent agents) to navigate and search the website, or to copy content from the website. We reserve the right to immediately block access to the site and close the account of users who violate this provision or any other provision in these terms and conditions.

2. Prices and shipping costs

The prices stated on bosembo.com include the statutory VAT, but exclude the shipping costs. Printing, typing errors and price changes reserved.

The shipping costs are the same for all orders, regardless of the size and weight of your order. The costs for each shipping option are clearly stated during the ordering process. Our shipping costs are clearly displayed at the checkout. shipping costs are subject to change and vary per region. In-store, catalog and online prices may vary. For orders from (a fixed value – independent of currency) of €50,- no shipping costs are charged.

3. Order/contract conclusion

You can only order via bosembo.com.

If you have registered your e-mail address, you will receive a confirmation by e-mail after placing an order. If we are unable to deliver your order, we will let you know as soon as possible. If the order has already been paid for, we will try to refund the payment via the payment method used by you. If the refund needs to be made in some other way, BOSEMBO will notify you and ask you to contact customer service who will handle the refund.

4. Returns/Cancellation orders

Cancelling an order is possible up to the moment of sending. After this moment, the order can be returned once the product has been received by the recipient/buyer. The costs of returning are initially for the buyer, however, when proof of the costs is sent, these and the entire purchase amount will be returned (maximum € 4.95 (fixed value) in shipping costs back). You can only return the product if it appears unused and has not been peronalised via the ‘customize product’ button on the product page. The maximum return period is 30 days, after this period it is no longer possible to return your order.

5. Payment methods

You can pay for your items in the ways shown below.

iDeal
During the ordering process you will be redirected to your bank to complete the payment. You have the option to pay via iDeal if you use online banking. Your payment will be immediately debited from your account.

PayPal
To complete the payment you will be redirected to the PayPal site where you can then log in with the relevant account that is designated for the payment.

 

6. Liability

These terms and conditions do not limit or exclude BOSEMBO's liability for matters that we cannot limit or exclude by law.

BOSEMBO accepts liability for death or personal injury caused by our negligence or that of our employees or representatives. We do not seek to exclude liability as a result of misrepresentation by our employees or representatives. In the event of a breach of these Terms, we will only be liable for losses that are reasonably foreseeable as a result of such breach.

MOSEMBO is not responsible for indirect losses that are incidental to the original loss or damage, such as loss of profit or loss of opportunity, or failure to deliver goods or to comply with any other obligation under these Terms. if such failure is the result of events beyond our control, including, but not limited to, fire, flood, storm, insurrection, political unrest, war, nuclear accident and terrorist activity.

Our total liability to you for any loss or damage incurred in connection with your order on bosembo.com is limited to the total amount of your order.

7. Colors and Dimensions

We make every reasonable effort to display the properties of our products, including composition and colours, as accurately as possible. The color you see depends on several factors: screen quality, app version, computer system, etc.

The dimensions of the items on bosembo.com are guidelines only. They are intended to give you an idea of ​​the model or fit of that particular item and do not guarantee the actual measurements of the item you will receive. The final dimensions of an item may vary depending on the material used in production.

8. Warranty

If the items purchased by you show defects, BOSEMBO.com will fully comply with the legal warranty regulations. If you have a complaint related to obvious material or manufacturing defects in goods supplied by us, including transport damage, you can inform us without delay by returning the goods together with the pre-printed return form.

 

9. Transfer

BOSEMBO.com reserves the right to transfer or assign to a third party any claims for payment (including any payment terms) in connection with the delivery of goods.

10. Immunity

If any part of these Terms is held to be invalid or void by any court or legislator, the remaining Terms will survive.

11. Proprietary Rights

All intellectual property rights, such as trademarks and copyrights in BOSEMBO.com, belong to BOSEMBO.com or its licensors. Any use of BOSEMBO.com or its contents, including copying or storing such contents in whole or in part, other than for your own personal and non-commercial use is prohibited without the prior written consent of BOSEMBO.com.
